Internet Marketing Service (IMS, we, us or our) provides internet marketing and related business services to Australian service businesses. This policy applies to personal information handled through this website, our forms, emails, telephone conversations, online meetings and service-delivery activities.

IMS handles personal information in accordance with applicable Australian law and adopts the standards reflected in the Australian Privacy Principles where they apply.

Personal information we may collect

The information collected depends on how you interact with IMS and may include:

  • your name, email address, telephone number and preferred contact details
  • your business name, role, website address, industry and service location
  • the nature of your enquiry, marketing concern, objectives and information you include in a message
  • records of correspondence, meetings, proposals, approvals and service delivery
  • billing, invoicing and transaction records where you engage IMS
  • website and technical information such as IP address, browser type, device type, referring source, pages visited, date and time
  • form metadata used for administration, security and spam prevention
  • feedback, testimonials or reviews where you choose to provide them
Please do not submit passwords, sensitive client information, confidential account credentials, health information, tax file numbers or other sensitive material through a general website form.

How we collect and hold information

We may collect personal information:

  • directly from you through website forms, email, telephone, meetings or service documents
  • when you request an Enquiry Review, contact IMS or engage a service
  • automatically through website logs, cookies, analytics and security technology
  • from a person you authorise to communicate with IMS
  • from publicly available business sources where it is lawful, fair and reasonably relevant to our work

Elementor form submissions may be stored in the website’s WordPress database and transmitted through email. Information may also be held in business email, secure cloud services, CRM or project-management systems used for administration and service delivery.

You may browse public pages without identifying yourself. Accurate contact information will normally be required where you ask IMS to respond, prepare a proposal or provide a service.

Why we collect, hold and use personal information

We may use personal information to:

  • respond to enquiries and arrange an Enquiry Review
  • understand your business, objectives and requested services
  • prepare proposals, agreements, recommendations and reports
  • provide, administer, improve and support IMS services
  • manage accounts, invoices, records and business relationships
  • operate, secure, troubleshoot and improve the website and forms
  • measure website performance and understand how visitors use the site
  • prevent spam, fraud, misuse and security incidents
  • comply with legal, regulatory, insurance and professional obligations
  • resolve complaints, disputes or potential legal claims

We will not use personal information for an unrelated purpose unless you consent or the use is otherwise permitted or required by law.

Website forms and confirmation emails

When you submit a Contact or Enquiry Review form, the information is used to receive, record and respond to your request. A copy may be stored under Elementor Submissions and delivered to IMS by email.

We may send an automated confirmation email to acknowledge receipt. That confirmation is a service communication relating to your request. It does not, by itself, add you to a newsletter or general marketing list.

If IMS later offers newsletters or promotional email, consent will be obtained or another lawful basis relied upon, and commercial messages will include a functional way to unsubscribe.

Cookies, analytics and similar technology

The website may use cookies, local storage, server logs and related technology for essential operation, security, preferences, analytics and performance measurement.

Where Google reCAPTCHA or similar security tools are enabled, technical and interaction data may be processed to help distinguish genuine users from automated activity.

You can alter browser settings to refuse or delete cookies. Doing so may affect parts of the website. Where a consent-management tool is provided, your choices will govern optional technologies covered by that tool.

Direct marketing

IMS may send marketing communications only where you have consented or where doing so is otherwise permitted by law. Each commercial electronic message will identify the sender and provide a functional unsubscribe method.

You may withdraw consent or unsubscribe at any time. An unsubscribe request will not prevent IMS from sending necessary service, transaction, security or legal communications.

When information may be disclosed

We do not sell personal information. We may disclose information only where reasonably necessary to:

  • website hosting, maintenance, form, email, analytics, security, CRM and cloud-service providers
  • contractors or specialists assisting with an agreed service, subject to appropriate confidentiality arrangements
  • accountants, insurers, lawyers or other professional advisers
  • government bodies, regulators, courts or law-enforcement authorities where required or authorised by law
  • a purchaser or adviser involved in a genuine business restructure or sale, subject to appropriate protections

Service providers are given only the information reasonably required for their function and are expected to handle it in accordance with their contractual and legal obligations.

Overseas processing and disclosure

Some technology providers used for analytics, security, email, cloud storage, CRM, website support or other business functions may process information outside Australia. Depending on the provider and service, this may include the United States and other countries in which the provider or its infrastructure operates.

Providers, locations and technical arrangements can change. IMS will take reasonable steps appropriate to the circumstances when selecting and using service providers and will update this policy where a material change affects our privacy practices.

Security, retention and deletion

IMS takes reasonable administrative, technical and organisational steps to protect personal information from misuse, interference, loss, unauthorised access, modification and disclosure. Measures may include access controls, strong authentication, updates, backups, security tools and limiting access to people who need the information.

No website, email or storage system can be guaranteed completely secure. If you believe information has been exposed or misused, contact IMS promptly.

Information is retained only for as long as reasonably required for the purpose collected, service delivery, administration, security, legal obligations, dispute management and legitimate business records. When no longer required, reasonable steps will be taken to delete or de-identify it, subject to lawful backup and recordkeeping requirements.

Artificial intelligence and automated decisions

IMS may use software or artificial-intelligence tools to assist with research, drafting, analysis, administration or service delivery. Appropriate care should be taken before personal information is entered into any external tool.

IMS does not currently use personal information in a solely automated process to make decisions that could reasonably be expected to significantly affect an individual’s rights or interests. If that practice changes, this policy will be updated before or when required by applicable law.

Accessing or correcting your information

You may ask whether IMS holds personal information about you and request access to or correction of that information. Contact IMS in writing and provide enough detail to identify the relevant records.

We may need to verify your identity before providing access or making a correction. Access may be refused or limited where permitted or required by law, including where disclosure would unreasonably affect another person’s privacy. If a request is refused, we will explain the reason where it is reasonable and lawful to do so.

IMS will not ordinarily charge for making a request. If a substantial cost would be involved in providing access, we will discuss any reasonable charge before proceeding.

Privacy questions and complaints

Send a privacy question or complaint to hello@internetmarketingservice.com.au with the subject line Privacy Request or Privacy Complaint. Please describe what happened, when it occurred, the information involved and the outcome you seek.

IMS will acknowledge the matter and aim to provide a substantive response within 30 days. Complex matters may require more time, in which case we will explain the reason and expected timeframe.

If the Privacy Act applies and you are not satisfied with our response, you may be entitled to complain to the Office of the Australian Information Commissioner after first giving IMS a reasonable opportunity to resolve the matter.
